1. Website Conditions of Use 1.1 Overview The User commits himself to the proper use of the website in accordance with law and the present Legal Statement. The User shall respond to the FEMP or to third parties for any damages that s/he may cause as a result of non-fulfilment of said obligation. Use of the website for purposes harmful to the property or interests of the FEMP or of third parties, or use that overloads, damages or renders useless the networks, servers and other information equipment (hardware) or information products and applications (software) of the FEMP or of third parties is expressly prohibited. 1.2 Contents The User commits himself to use the Contents in keeping with Law and the present Legal Statement, as well as the other conditions, regulations and instructions that may be applicable, as the case warrants, in accordance with the provisions set forth in Clause 1 of this Legal Statement. Merely by way of enumeration, the User, in accordance with the laws in force, must abstain from: a) Reproducing, copying, distributing, making available, communicating publicly, transforming or modifying the Contents, except in cases authorized by law or expressly allowed by the FEMP or by whoever exercises the entitlement to the rights of use thereof, as the case warrants. b) Reproducing or copying for private use those Contents that may be considered as Software or Database, as set forth in the laws in force regarding intellectual property, as well as publicly communicating these or making these available to third parties where these acts necessarily involve reproduction by the User or by a third party. c) Extracting and/ or reusing all or a substantial part of the Contents making up the website as well as the databases that the FEMP may put at the disposal of Users. 1.3 Forms for Data Gathering Without prejudice to what is set forth in the Privacy Policy, the use of certain services or petitions addressed to the FEMP are subject to the condition of previously filling up the pertinent User registration form. All the information that the User facilitates through the website forms for the purposes previously mentioned or for any other purposes must be true. To this end, the User attests to the authenticity of all the data transmitted and commits himself to maintain the information facilitated to the FEMP perfectly updated, such that it responds at all times to the real situation of the User. In any case, the User shall be the sole party responsible for any false or inaccurate statements made and for the damages that may be caused to the FEMP or to third parties by the information facilitated. 2. Exclusion of Liabilities 2.1 For Information The FEMP shall not be liable either for the decisions made on the basis of the information provided on the website or for the damages that may arise for the User or for third parties due to actions solely based on the information obtained from the website. 2.2 For Service Quality Access to the website does not imply an obligation on the part of the FEMP to monitor the absence of viruses, worms or any other harmful information technology element. It falls upon the User, in any case, to avail of the appropriate tools for the detection and disinfection of harmful information programs. The FEMP shall not be liable for damages occurring in the information equipment of Users or third parties in the course of rendering website services. 2.3 For Service Availability Access to the website requires services and supplies from third parties, including transport over telecommunications networks, the reliability, quality, continuity and operation of which do not depend upon the FEMP. Consequently, the services provided through the website may be suspended, cancelled or may become inaccessible prior to or simultaneously to the rendering of website services. The FEMP shall not be liable for damages of any kind that occur in the User arising from breakdowns or disconnections in telecommunications networks that may lead to the suspension, cancellation or interruption of website services before or while they are being rendered. 2.4 For Contents and Services linked on the Website The links on the website may take you out of the FEMP network. The FEMP is not aware of the contents and services of the websites linked and thus assumes no liability, either for damages that may arise owing to the illegality, quality, outdated character, non-availability, error and uselessness of the contents and/ or services of the Linked Websites, or for any other damages that cannot be directly attributed to the FEMP. The links are furnished by the FEMP in good faith and thus it assumes no liability for any possible changes in the linked websites. In no case shall the existence of linked websites imply the existence of agreements with the persons responsible for these or the owners thereof, or the recommendation, promotion or identification of the FEMP with the statements, contents, or services provided.
